 Last updated: June 22, 2022

 Welcome to our website, mobile and/or software applications, or other related service provided by Apothca, a Massachusetts corporation, or its direct or indirect affiliates, subsidiaries, parent company, or other related companies (collectively, “Apothca,” “us,” “our,” and/or “we”). We value your security and privacy and provide this Privacy Policy (“Policy” or “Privacy Policy”) to describe the information we gather from you when you use the website (the “Site”), home delivery, mobile and/or software applications, or other related services and the information that we collect when you visit the brick-and-mortar stores that we operate, and when you otherwise contact us (collectively, the “Services”) and how we use, process, and disclose that information. In addition, we may post additional privacy statements for some portions of the Site or Services. By submitting personal information through our Site or Services, you expressly consent to the transfer of your personal information to our servers (or our service provider’s servers) in the U.S. for our collection, use, and disclosure in accordance with this Privacy Policy.

 The term “personal information,” as used in this Privacy Policy, means information that relates to or is reasonably capable of being associated with a specific individual.

 Information We Collect from You Through Your Use of the Site or Services

 Site or Services: You may provide us with additional information by filling in forms on the Site or Services or by corresponding with us by phone, text, email, live chat, or otherwise and when you make purchases at our brick-and-mortar stores or via home delivery. When you create an account, we collect the following types of information from you:

  • Name;
  • Contact information such as your email address and phone number;
  • Your physical address for the delivery of products;
  • Demographics information such as your gender and location; and
  • Any other information that you provide us, such as birthdate and age.

 We automatically collect information about how you use our Site or Services, for example, pages you have viewed and products you have purchased. We also collect certain technical information about your device including your Internet protocol address, geo-location information, your browser type, language and identifying information, your operating system and application version, device types, device model and manufacturer, device identifiers, and your device operating system type and version.

 Cookies and Tracking Technologies: We also use cookies, Web beacons, and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. Cookies are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which usually stay on your computer until you delete them) to provide you with a more personal and interactive experience while using the Site or Services. We also use cookies for data analytics purposes, including from Google Analytics. You can find more information on how Google uses data from these cookies at google.com/policies/privacy/partners (or at any subsequent URL at which such policy is located). You should consult your web browser to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Site or Services. Web beacons are digital images that are used to log information on the Site or Services or in our emails. We use Web beacons to manage cookies, count visits, and to learn what marketing works and what does not. We also use Web beacons to tell if you open or act on our emails.

 Third-Party Data Collection: Others, including third-party analytics service providers and advertising partners, may also collect personally identifiable information about your online activities over time and across different Web sites when you use our Services, including as described in this Privacy Policy. This Policy does not apply to and we are not responsible for those other parties. Third-party analytics services may use cookies and web beacons through the Site or Services (for example Google Analytics and ChartBeat) and platform device identifiers and software agents on and through our mobile services (for example Swrve) to provide us with information about how you use and interact with our Site or Services. We encourage you to review the privacy policies of these third parties to learn about your choices about information they collect from you.

 Mobile Device Information: When you access and use the Site or Services from your mobile devices, we receive information from your mobile device.  This may include your location data, IP address and device type. You may manage how your mobile device and mobile browser share location information with us, as well as how your mobile browser handles cookies and related technologies by adjusting your mobile device privacy and security settings.  Please refer to instructions provided by your mobile service provider or the manufacturer of your device to learn how to adjust your settings.

 Social Network Services: If you create an account using, or otherwise connect your account to, a social networking services account (e.g. Twitter or Facebook), we may also collect information provided to us by such social networking service including for example your: name; email address; birthday; geographic location; interests; profile picture; gender; networks; user ID; list of friends; and any information you have made public on such social networking account.

 Personal Information from Other Sources: We may receive personal information about you from third parties. We may associate this information with the other personal information we have collected about you.  The collection, use, and disclosure of information by third parties is governed by the privacy policies listed on the website where the information was submitted by the user.  Third parties may send their own cookies and pixel tags to you and may collect information and use it in a way that is inconsistent with this Privacy Policy.  Please carefully review these third-party privacy policies to understand how your information may be collected, used, and disclosed by these third parties.

 Third-Party Cookies: In addition to our use of Google Analytics as described above, we may engage third-party service providers, including Facebook and Instagram to serve ads to you about our products and services as you browse the Internet (to the extent permitted by applicable laws, rules, and regulations).  If ads are served to you, these third-party providers may use their own cookies tags to track your online activities and purchases in order to deliver targeted advertising based on your interests.  To the extent applicable, you can learn more about Facebook’s advertising cookies and opt-out options by visiting

 https://www.facebook.com/policy/cookies/. You can learn about Instagram’s advertising cookies and opt-out options by visiting https://help.instagram.com/1896641480634370?ref=ig.

 Pixel Tags: Pixel tags (a.k.a. clear gifs) are tiny graphics with a unique identifier, similar in function to cookies, which allow us to monitor the use of the Site or Services and to deliver banner advertisements to you about our products and services as you browse the Internet (to the extent permitted by applicable laws, rules, and regulations). Pixel tags generally work in conjunction with cookies, registering when a particular computer visits a particular page.  You cannot decline pixel tags; however, if you turn off cookies, the pixel tag will simply detect an anonymous visit.  In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.
